Acceptable Use Policy

By accessing or using Oration's Platform Services or other associated software, you are agreeing to the terms of this Acceptable Use Policy, in addition to any terms agreed to in a Services Agreement and/or Oration’s Terms of Use (“Agreement”). Any capitalized terms in this AUP will have the same meaning as set out in the Agreement. If you are using the Platform Services on behalf of an entity, you represent and warrant that you have authority to bind that entity to the AUP and by accepting the AUP, you are doing so on behalf of that entity (and all references to “you” in the AUP refer to that entity). Oration reserves the right to update this AUP by providing notice on this website.

Prohibited Actions. You shall not, except to the extent expressly agreed upon in writing by Oration Support:

1. modify, translate, reverse engineer, decompile, disassemble, decrypt or in any other way try to procure the human decipherable form of the Platform Services;
2. create adaptations, translation or derivative works based on the Platform Services;
3. undertake benchmark trials using all or any part of the Platform Services;
4. circumvent any user limits or other use restrictions that are built into the Platform Services;
5. remove any proprietary notices, ownership labels, classified legends or marks from the Platform Services or Oration Support technology;
6. disseminate, market, license, sublicense, let, rent, give the loan of, or sub-authorize any element of the Platform Services to any third party;
7. meddles with, disturbs, destroys, or accesses in an unlawful way the server networks, connections, records, or other assets and tools or services of Oration Support or any related third party Oration Support uses to make available the Platform Services;
8. access the Platform Services in any sanctioned countries or territories, including accessing any features of the Platform Services where such feature may be banned or restricted;
9. access the Platform Services in order to: (a) build a competitive product or service; or (b) copy any ideas, features, functions or graphics of the Platform Services;
10. Input any malicious prompts into the Platform Services (including any generative AI features of the Platform Services) or otherwise attempt to prompt the Platform Services to (a) generate any harmful, inaccurate, illegal, or offensive content; (b) reveal confidential or personal information; or (c) reveal or abandon its programmed instructions;
11. Use any generative AI features of the Platform Services to generate (a) medical, legal, financial, or other professional advice; (b) content that may have biased or unfair impacts on individuals; (c) a decision about an individual that may have material impacts on the rights or the mental, physical, financial or emotional well-being of an individual; or (d) any automated decision about an individual without such individual’s consent.
12. Make any misleading claims or suggestions that content generated by generative AI features was created by a human being;
13. not use the Platform Services for any activity where the use or failure of the Platform Services could result in death, personal injury, or severe physical or environmental damage, including the operation of nuclear facilities, air traffic control systems, life support systems, or other mission-critical applications (“High Risk Activity”);
14. use the Platform Services in a manner that:

• infringes or violates the Intellectual Property Rights or any other rights of Oration Support or any third party;
• violates any law or regulation, including any applicable export control laws;
• is harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, or otherwise objectionable;
• violates any applicable Oration Support agreement or, to the extent you use a third-party integration, the applicable third-party policy;
• attempts, in any manner, to obtain the password, account, or other security information from any other user;
• attempts to determine or monitor the location of any individual; or
• violates the security of any computer network, or cracks any passwords or security encryption codes; or runs any form of auto-responder or “spam” on the Services, or any processes that run or are activated while you are not logged into the Services, or that otherwise interferes with the proper working of the Services (including by placing an unreasonable load on the Services’ infrastructure);

Limited Exception for Good Faith Testing

Customers may submit, collect, generate, classify and filter content in ways that would otherwise violate this Acceptable Use Policy solely to evaluate, train, and/or improve Customer’s Oration instance of the Platform Services, provided such activities are in compliance with Oration’s Vulnerability Disclosure policy. Customers shall promptly report to Oration (i) any security vulnerability; (ii) harmful or illegal content; or (iii) any unauthorized third-party confidential information. Customers remain responsible for all legal compliance relating to such content, including without limitation, retention, destruction, and reporting as necessary.
